❓ Understanding EPR

What is Extended Producer Responsibility?

EPR is a policy approach that holds producers responsible for the entire lifecycle of their products, including take-back, recycling, and final disposal. In Poland, this means you need specific registration numbers to legally sell certain products.

FAQ

EPR in Poland means that producers are responsible for financing and managing certain end-of-life obligations for products they place on the Polish market. For most businesses on this site, that usually means packaging, electrical and electronic equipment, and batteries.
If you place packaged products on the Polish market, you will usually need to register and report your packaging volumes. This applies broadly to importers, manufacturers, and businesses that first make packaged goods available in Poland.
If you sell electrical or electronic equipment in Poland, WEEE obligations may apply. This usually covers many common categories such as consumer electronics, IT equipment, household devices, and other products that depend on electric current or electromagnetic fields.
If you place batteries on the Polish market, or sell products that contain batteries, battery producer responsibility may apply. This can cover portable batteries, batteries built into products, and in some cases industrial or automotive batteries.
In many cases, you count as a producer if you manufacture under your own name, import products into Poland, or are the first business to make covered goods available on the Polish market. For foreign e-commerce sellers, direct sales into Poland can also trigger producer responsibility.
For some Poland EPR obligations, especially in cross-border situations, foreign companies may need an authorised representative or local setup to manage their producer responsibility correctly. Whether this is required depends on the product stream and how the products are sold into Poland.
Usually yes. Polish EPR obligations generally involve ongoing annual reporting of quantities placed on the market, and in some cases additional reporting on collection or treatment depending on the product category and the scheme involved.
